Welcome to GoFish (www.mygofish.in). These Terms and Conditions govern your use of our website, mobile application, and services. By accessing or using our platform, you agree to be bound by these terms. Please read them carefully before placing an order.

1. Definitions

  • "GoFish," "we," "us," or "our" refers to GoFish, the owner and operator of www.mygofish.in
  • "Platform" refers to our website (www.mygofish.in) and mobile applications
  • "User," "you," or "your" refers to any individual or entity accessing our Platform
  • "Products" refers to fish, seafood, poultry, and other items available for purchase
  • "Services" refers to all services provided through our Platform including ordering, delivery, and customer support

2. Eligibility

2.1. You must be at least 18 years of age to use our Platform and make purchases.

2.2. By using our Platform, you represent and warrant that you have the legal capacity to enter into binding contracts.

2.3. Our services are currently available only within select areas in Kerala, India. Delivery availability is subject to your location.

3. Account Registration

3.1. To place orders, you may need to create an account with accurate and complete information.

3.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

3.3. You agree to notify us immediately of any unauthorized use of your account.

3.4. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activities.

4. Products and Pricing

4.1. All products displayed on our Platform are subject to availability. We reserve the right to limit quantities and discontinue products without prior notice.

4.2. Prices are listed in Indian Rupees (INR) and are inclusive of applicable taxes unless otherwise stated.

4.3. Product weights are approximate and may vary slightly. Fish weights are measured before cleaning and cutting.

4.4. We strive to display accurate product images and descriptions. However, actual products may vary slightly in appearance due to the natural characteristics of seafood.

4.5. We reserve the right to modify prices at any time without prior notice. Price changes will not affect orders that have already been confirmed.

5. Orders and Payment

5.1. Order Placement: By placing an order, you make an offer to purchase the selected products. Order confirmation constitutes our acceptance of your offer.

5.2. Payment Methods: We accept payments through:

Credit Cards / Debit Cards

    • Net Banking
    • UPI (Unified Payments Interface)
    • Digital Wallets
    • Cash on Delivery (where available)

5.3. Payment Processing: Online payments are processed securely through Razorpay Payment Gateway. By making a payment, you also agree to Razorpay's terms of service. GoFish does not store your complete card details on our servers.

5.4. Payment Security: All online transactions are encrypted and secured. We use industry-standard security measures to protect your financial information.

5.5. Order Confirmation: Upon successful payment, you will receive an order confirmation via email and/or SMS. This confirmation includes your order details and estimated delivery time.

5.6. Order Cancellation: Orders can be cancelled before they are dispatched. Once an order is out for delivery, cancellation may not be possible. Please refer to our Refund Policy for details.

6. Delivery

6.1. Minimum Order Requirement

A minimum order of 1 kg of products or a cart value of ₹500 or above is required to place an order.

6.2. Standard Delivery

Delivery is FREE for orders within a 5 km radius from our store location.

For deliveries beyond 5 km, delivery charges will apply based on distance and will be displayed at checkout.

6.3. Express Delivery

We offer Express Delivery for customers who need their orders urgently, delivered within 1 hour of order confirmation.

Within 5 km: ₹50 express delivery charge

Beyond 5 km: ₹50 + ₹10 per additional km

Express Delivery is subject to availability and operational hours. The express delivery option will be visible during checkout if available for your location.

6.4. Quality Guarantee and Returns

We stand behind the freshness and quality of our products. If you receive any product with quality issues such as spoilage, foul smell, or damage:

You must report the issue within 2-4 hours of delivery.

Contact us immediately at +91 89211 65365 with photographs of the product.

Upon verification, we will arrange a return pickup or provide a refund/replacement.

Returns will not be accepted after 4 hours of delivery due to the perishable nature of our products.

6.5. Third-Party Pickup (Self-Collection)

Customers may choose to collect their orders through third-party delivery services such as Porter, Swiggy Genie, Zomato, Dunzo, or similar platforms.

Please call us at +91 89211 65365 to place your order for third-party pickup.

Ensure the third-party delivery person provides the correct order details and OTP (if applicable) for verification.

Once the order is handed over to the third-party service, GoFish is not responsible for any delays, damages, or quality issues during transit.

6.6. We offer various delivery slots. You may select your preferred slot during checkout, subject to availability.

6.7. Estimated delivery times are indicative and may vary due to factors beyond our control including weather, traffic, and unforeseen circumstances.

6.8. You or an authorized person must be present to receive the delivery. If delivery cannot be completed due to your unavailability, re-delivery charges may apply.

6.8. Please inspect your order upon delivery. Any visible damage or discrepancy should be reported immediately.

7. Quality Assurance

7.1. We are committed to delivering fresh, high-quality products. Our fish and seafood are sourced daily and undergo quality checks.

7.2. Due to the perishable nature of our products, we recommend immediate refrigeration upon delivery and consumption within the recommended timeframe.

7.3. If you receive a product that does not meet our quality standards, please contact us within 24 hours of delivery for resolution.

8. User Conduct

8.1. You agree not to use our Platform for any unlawful purpose or in violation of these terms.

8.2. You shall not:

    • Provide false or misleading information
    • Attempt to gain unauthorized access to our systems
    • Interfere with the proper functioning of our Platform
    • Use automated systems to access our Platform without permission
    • Engage in any activity that could harm our reputation or business

9. Intellectual Property

9.1. All content on our Platform including logos, images, text, graphics, and software is the property of GoFish or its licensors and is protected by intellectual property laws.

9.2. You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent.

10. Limitation of Liability

10.1. GoFish shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Platform or products.

10.2. Our total liability for any claim shall not exceed the amount paid by you for the specific order in question.

10.3. We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.

11. Indemnification

        You agree to indemnify and hold GoFish, its officers, directors, employees, and agents harmless from any claims, damages, losses, or expenses arising from your violation of these terms or misuse of our Platform.

12. Modifications to Terms

12.1. We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our Platform.

12.2. Your continued use of our Platform after any modifications constitutes acceptance of the updated terms.

13. Governing Law and Jurisdiction

13.1. These Terms and Conditions are governed by the laws of India.

13.2. Any disputes arising from these terms or your use of our Platform shall be subject to the exclusive jurisdiction of the courts in Kerala, India.

14. Severability

        If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
